HCS SB 735 -- LABOR AND INDUSTRIAL RELATIONS COMMISSION SPONSOR: Crowell (Pratt) COMMITTEE ACTION: Voted "do pass" by the Committee on Workforce Development and Workplace Safety by a vote of 12 to 0. This substitute specifies that the notice of appeal, application, or other documents required by law to be filed with the Missouri Labor and Industrial Commission will be deemed filed as of the date postmarked by the United States post office or as of the date certified by a commercial parcel delivery service as the date its customer deposited for delivery the envelope or container in which the documents are received. The substitute also allows notices, applications, or petitions to be transmitted by electronic facsimile to the commission. If the last day for filing an appeal or petition for review falls on a Saturday, Sunday, or a legal holiday, the filing is deemed timely if accomplished on the next subsequent day that is not a Saturday, Sunday, or legal holiday. FISCAL NOTE: No impact on state funds in FY 2007, FY 2008, and FY 2009. PROPONENTS: Supporters say that the bill codifies the Labor and Industrial Commission's rules regarding the date mailed and the use of facsimiles and allows commercial parcel delivery services to deliver notices of appeal and petitions for review to the commission.
